Introduction

These are legal terms and conditions under which we sell our products listed on our website to you. Our website is www.rialine.co.uk

Please read these terms and conditions carefully and keep them for your records before purchasing any products from us. By using our website, whether you purchase products from us or not, indicates you accept our terms and conditions and agree to our Privacy Policy regardless of whether you choose to register with us or not. Please do not use our website if you do not accept any of our terms and conditions.

Service Availability

Your Status

By placing an order through our website, you agree you are:

  • Legally capable of entering into a binding contract.
  • You are at least 18 years old.
  • You have permission or possess a valid credit or debit card to make payment or are authorised to pay using one of our other accepted methods of payment.
  • You are a resident in a country we deliver to (please see our delivery and shipping page)

When You Place an Order and when a contract is formed.

  • When you place an order, it is your responsibility to only provide accurate information which is complete with your title, first name, surname, phone number, email address, delivery and billing address and any payment information true to yourself. It is your responsibility to check that your order is correct, so please check this carefully before submitting to us. If an order is incorrect or you wish to make an amendment, please contact customers service immediately using the contact details you have already provided.
  • Once you have placed an order you should receive a conformation email acknowledging the order from us to the email address you provided. If you do not receive this email, please contact us.
  • Please note the confirmation email from us does not mean your order has been accepted as all orders are subject to availability and acceptance by us, which we may refuse for any reason.
  • After you have placed an order, we immediately contact your bank or card issuer for authorisation to take payment from your account. The order will not be processed until we have received payment in full.
  • If a payment has been made in full and the product/s is/are available a shipping/delivery email will be sent to you. This is the point a contract between you and us will have be formed. If products are sent in different consignments or different times then the shipping/delivery email sent for these individually constitutes to a separate contract between you and us.
  • If a product is not in stock or unavailable you shall receive an email prior to the shipping/delivery email to ask whether you would still like to proceed. If you decide to proceed we are under no obligation to supply the product until we know we can supply it and have given you a shipping/delivery confirmation. I f your order contains multiple products and some of those products are unavailable we may still process the order with the available products we have.
  • We may make minor changes to a product to reflect changes in legislation or regulatory requirements.
  • These terms and conditions and any contract between us are only in the English Language and you should keep a note of these terms and conditions for your future reference.

Delivery

  • Once an order has been accepted and you have received the delivery confirmation, we shall aim to fulfil your order as soon as possible depending on the delivery service which is to be used at that time.
  • For more information about our chosen delivery partners please see our delivery and shipping page.
  • If an order is delayed you shall be contacted with an estimated delivery date. Please note this date is an estimate only and we cannot guarantee delivery by the estimated delivery date.
  • Orders can be delivered in different consignments depending on availability but you will not be charged any extra for this.
  • Any risk or damage to or loss of the products shall pass to you at the time of delivery.
  • The ownership title of the products shall be passed on to you at the time of delivery.
  • If no one is available to take the delivery at the address specified, then the carrier can re-attempt delivery or communicate with you according to their regulations. In which case you must contact them to rearrange a delivery.
  • Please do not refuse the delivery of your order, however if delivery has been refused then this will incur a cost of the original delivery fee plus the fee it costs RIA Line to have it returned.
  • Please note working days exclude Sundays and bank holidays.
  • If you wish to dispute delivery on an order you have 28 days from when the carrier has fulfilled delivery. We reserve the right to request evidence before issuing any refunds or associated delivery costs.
  • Please note any images of the products on our website or any other advertising channels are for illustrative purposes only and so your products can vary from these images. We cannot guarantee that how the products are displayed on your device or any other marketing materials accurately reflect the colours of the products delivered to you even though we try our best to display accurate images.
  • Any products purchased from us may not be resold or made available for resale on a commercial basis.

Price and Payment

  • The price shown for the products on our website are in pounds sterling (GBP) and are inclusive of any VAT at the relevant rate chargeable at that time. The price does not include delivery charges, this is an additional cost to you calculated separately at the checkout process.
  • We can change the price of our products on our website at any time without having to give notice. Any changes in price do not affect orders that we have already accepted. The only exception to this would be if the rate of VAT changes, then this will be reflected across ALL orders that are still to be paid for in full to us.
  • Payment is accepted by us via debits card, credit card, Apple Pay (IOS only), PayPal. We accept VISA, VISA Electron, Mastercard, Maestro and American Express.
  • You have the duty to pay for the products you order including the relevant delivery charges. Once you reach the final billing page and submit your order with your chosen method of payment then we will contact your bank or card issuer to authorise us to take payment.
  • If you are using PayPal such payment will be subject to additional terms between you and PayPal, please see PayPal’s additional terms and conditions.   • In an unforeseen circumstance where an obvious pricing error has been made and where it would have been easily recognised by you also, then we may end the contract, refund you of any monies you have paid under the contract and require the products to be returned to us.

Your Right to Cancel the Contract for EEA and UK customers only.

  • Customers that fall within this area have a legal right to cancel their order (subject to acceptance) anytime until 14 days after you or a nominated person has received the delivery. If the order has been split up in subsequent deliveries than the 14 days will start upon the last delivery of the products. Unfortunately, if you reside outside of the EEA or UK then you do not have this automatic right to cancel.
  • If you wish to cancel the contract, please contact us by the end of this 14 days period via our Contact Us page. You may (but are not obliged to) use the following template in your email:
  • Your Full Name (or Customers Name if different) and stating you wish to cancel your order with a reason if necessary.
  • Names of any products to be returned,
  • Ordered On Date,
  • The Order Number,
  • Your Address (or Customers address if different)
  • Date of the day you are making the return.
  • Alternatively, you can just contact us through our Contact Us page.
  • The right to cancel is not applicable for any lingerie, swimwear if the hygiene seal has been broken.
  • If you choose to return the products to us by using a different carrier other than the ones we nominate then you are responsible for the products including any loss or damage they may incur until we receive the product/s.
  • If you decide to cancel the contract after the products have been delivered to you, it must be within the 14-day period, and you must send the products back to us by following our Return Policy set out below.

Return Policy

  • You may only return Products in accordance with your Right to Cancel (see above) and in accordance with our Returns & Refund Policy. 
  • If you exercise Your Right to Cancel as mentioned above, then you must return the products in accordance with this Return Policy within the 14 days of you notifying us of your cancellation.
  • If all the terms and conditions and criteria of making a return have been met and accepted by us then we will refund the payment originally received from you in respect of the cancelled product/s only, the original delivery cost will not be refunded.
  • In circumstances where we suspect the products have been mishandled then we may deduct your refund to take into account the loss in value for the rejected products.
  • Products should be returned to us in an unused condition and should not have been worn. We reserve the right to withhold any refunds and block your account (and any associated accounts) from placing orders with us in the future where we suspect any fraudulent activity has taken place. However, if this has happened to you and you believe we have made a mistake please contact us to discuss the matter further.
  • In circumstances where we suspect fraudulent activity, including but not limited to, in regards to delivery where an order has been placed but not received, or items returned do not match what you ordered, or if we suspect that you have not returned items to us and/or have provided us with counterfeit proof of return, we reserve the right to withhold any refunds and block your account (and any associated accounts ) from placing orders with us in the future. However, if this has happened to you and you believe we have made a mistake please contact us to discuss the matter further.
  • You are responsible for the costs of returning any of our products back to us.
  • All Returns must meet our Return Criteria (also in our Returns & Refund Policy) in order to be successful.
  • Where applicable only and where exchanges are accepted, exchanges only apply for the same item in a different size. We cannot exchange for different style items.
  • No sale items or products given in a promotion can be returned.

Return Criteria

  • Items should be returned to us in a new and unused condition in the original packaging wherever possible.
  • Items must be in a resalable condition.
  • Items must have all RIA LINE swing tags, neck labels, security tags and have no signs of tampering.
  • Items must be unworn and unwashed.
  • Items must not have any pet hair or smell of any type of smoke.
  • Items must not be stained of any kind including and not limited to fragrance marks, deodorant marks, makeup, fake tan.
  • All hygiene labels should still be intact and must not have been removed.
  • All items must be returned as dispatched, this means please fold and button up, and use the original packaging where possible.
  • Items that do not meet these criteria will not be accepted and you will not receive a refund and you must pay for the cost of postage for the item to be returned back to you.

Your Right for a Refund for EEA and UK customers only.

If you are a resident within the EEA and UK and decide you want to cancel the contract under ‘Your Right To Cancel the Contract’ above. We will:

  • Refund you the price you paid for the product/s only excluding the delivery cost it cost you to return the package once the return has been accepted by us and met all our Return criteria and policies.
  • Please note we may reduce your refund to reflect any reduction in the value of our products if this has been caused by any mishandling. If a refund is given prior to us inspecting the goods and we later find out they have been mishandled, you are liable to pay us an appropriate amount to cover this loss in value.
  • In a case where delivery has been refused, any refund we make will be minus the total delivery fee and the fee RIA Line pay to have it returned.
  • Eligible refunds will be credited back to the original purchaser’s credit card.

Faulty Products

  • If you are a consumer, you have a legal rights in relation to products being faulty and not fitting their description. These legal rights are not affected by your right of cancellation or anything else in the Terms and Conditions.
  • We are under legal duty to provide products that conform to the contract.
  • If you consider that any product, we have supplied to you is faulty or misdescribed please notify us as soon as you can through our Contact Us page and in accordance with our Return Policy.
  • If you discover your product is faulty after 14 days, we reserve the right to request for evidence, such as images of the defects before any refunds are issued.

Our Rights to Cancel the Contract

We may end the contract between you and us at any time by emailing you if:

  • You do not make payment when it is due.
  • You do not, within reasonable time of us requesting for it, provide us with the necessary information needed for us to provide you with the products.
  • You do not, within reasonable time, allow us to deliver the products to you.
  • We suspect fraudulent activity with your account or from you in relation to returns and refund requests.
  • Where a price error has occurred, we will refund you in advance for the products we have not provided.
  • If we fail to comply with our Terms and Conditions, we will refund you in advance for the products we have not provided.

Our Liability

  • If we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if at the time the contract was made both we and you knew it would happen.
  • We only supply products for domestic and private use and not for any commercial, business or resale purpose. If you use the products in anything other than private or domestic use as outlined, we are not liable to you for any loss of profit, loss of business, loss of anticipated savings, business interruption or loss of business opportunity.
  • We will not be responsible for any delay or failure to comply with our obligations if the delay or failure arises from any cause which is beyond our reasonable control and falls within Events Outside Our Control. This does not affect your statutory rights.
  • If an Event Outside Our Control takes place that affects the performance our obligations, we will contact you as soon as possible. Please note our obligations under these Terms and Conditions will be suspended and the time for performance will be extended for the duration of the Event Outside Our Control. We will arrange a new delivery date with you after the Event Outside Our Control is over.
  • You may cancel an order which is affected by an Effect Outside Our Control if there is a risk of substantial delay. To do so please Contact Us.
  • We do not in any way exclude or limit our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any matter for which we may not exclude or limit our liability under any applicable law.

Other Important Terms

  • Any contract between you and us is binding. No other person shall have any rights to enforce any of its terms. Nothing in these Terms and Conditions affects your legally rights as a consumer under the applicable law jurisdiction in which you are resident.
  • If we must contact you, we will do so by phone call or email using the contact details you provided to us in your order, unless you have asked us to contact you by another means.
  • When we refer to ‘in writing’ with these Terms and Conditions we are referring to email.
  • We may change the Terms and Conditions from time, the Terms and Conditions applicable to you will be those that are displayed on our site when you place your order, except when changes are required by law, regulation, or government body.
  • We may transfer, assign, charge, sub-contract and/or dispose part or all of a contract at any time. We will inform you by email if this happens.
  • Each of the paragraphs in these Terms and Conditions operate separately. If any court or relevant authority deems them unlawful the remaining paragraphs will remain in force and full effect.
  • In circumstances where there has been a delay in us insisting you to follow these Terms and Conditions or if we delay taking the necessary steps against you in respect of breach of contract it does not exempt you from complying, and we can still take these steps at a later date. This includes but not limited to in cases where a payment has been missed but we continue to deliver the products.
  • These Terms and Conditions shall be governed by and construed in accordance with English Law and shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer nothing in this clause shall limit your rights to bring actions against us or to require proceedings to take place in your country of residence.
  • You may not transfer, assign, or dispose any part or all of this contract.

After – Sales and Complaint Procedure

  • Any questions, comments or complaints relating to these Terms and Conditions, or our products should be made through our Contact Us page and we will attempt to resolve the issue using our internal complaints procedure.
  • If you are not happy with how we have handled a complaint and wish to take the matter further without having to go to court, you may wish to contact the Retail Ombudsman or the Citizens Advice Service.

  • Please note we are not obliged to accept the jurisdiction of the aforementioned provider.
  • In addition, please note that any disputes may be submitted for online resolution to the European Commission Online Dispute Resolution platform although we are not obliged to accept the jurisdiction of the relevant ADR provider.
